Mediation - What's in a name?

'Mediation' covers many different things.

 

In many cases the term 'mediation' is incorrectly defined. Ombudsmen, debt mediators, etc. mediate effectively in all kinds of domains, but this form of mediation is not the same as what is determined under mediation in the Judicial Code.

 

The mediation offered by Van Doosselaere Advocaten is a voluntary and confidential process for managing conflicts in which the parties rely on an independent and impartial third party, the mediator.

 

The task of this mediator is to help the parties to reach an equitable agreement themselves, with full knowledge of the facts, that respects the needs of all intervening parties. The term conciliation is equivalent to mediation.

 

Mediation is (across all cultures) one of the oldest and most natural ways to resolve conflicts. Each of you has undoubtedly intervened several times as a mediator, perhaps even unconsciously, for example to resolve a (family) dispute.

 

However, when mediation is carried out by professionals within the meaning of the law of 21 February 2005, it ensures the legal security of the commitments associated with it.
